These Terms of Service ("Terms") govern your access to and use of the website at simonexpress.com, our recruiting communications (including phone, email, and SMS), and any related services (collectively, the "Services") operated by Simon Express ("we", "us", or "our").
By accessing or using the Services, including by submitting an application, providing your contact information, or replying to a Simon Express text message, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.

2. Eligibility
You must be at least 18 years old to use the Services. If you are using the Services in connection with employment as a commercial driver, you must hold a valid Commercial Driver's License (CDL) issued by a U.S. state or possess the qualifications required for the position you are pursuing.
By using the Services you represent and warrant that the information you provide is true, accurate, and complete to the best of your knowledge.

- View open driving positions
- Submit a driver application
- Communicate with our recruiting team
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms
- Submit false, misleading, or fraudulent information
- Attempt to gain unauthorized access to the Services or the systems behind them
- Scrape, harvest, copy, or reverse-engineer the Services or any data they expose, except as expressly permitted by us in writing
- Use the Services to transmit malware, harassment, spam, or any unsolicited communications
- Interfere with the operation, security, or integrity of the Services or other users' use of them
4. Recruiting Communications
If you provide your phone number or email address to Simon Express, you consent to receiving recruiting communications by phone, email, and — where you have separately opted in — SMS / text message, in connection with our hiring process.
SMS messaging. SMS communications are governed by the SMS terms in our Privacy Policy. In summary:
- We send text messages only to individuals who have explicitly opted in.
- Message frequency varies based on your conversation with our recruiting team.
- Message and data rates may apply.
- Carriers are not liable for delayed or undelivered messages.
- Reply HELP for help, STOP to unsubscribe.
Email. You can unsubscribe from recruiting email at any time by clicking the unsubscribe link in any message or by emailing recruiting@simonexpress.com.
Phone. You may decline a phone call from us at any time and may ask us not to call you again.
5. Employment Decisions
Submitting an application, communicating with our recruiting team, or providing information through the Services does not constitute an offer of employment, contract of employment, or guarantee of any specific position. All employment decisions are made at our sole discretion subject to applicable law. Employment with Simon Express is at-will to the maximum extent permitted by Utah law.
Where required, we will obtain your written authorization before conducting background checks, motor-vehicle-record checks, or other pre-employment screenings.

The Services, including all content, design, logos, trademarks, and software, are the property of Simon Express or its licensors and are protected by U.S. and international intellectual-property law. You may view and use the Services for the purposes described in Section 3, but you may not copy, modify, distribute, sell, or create derivative works without our prior written consent.
The Simon Express name and logo are trademarks of Simon Express. You may not use them without our prior written consent.
7. Third-Party Services
The Services may contain links to or rely on third-party websites and services (for example, payroll providers, background-check vendors, telephony providers). We are not responsible for the content, terms, or privacy practices of those third parties. Your use of any third-party service is governed by that third party's own terms and policies.

You agree to defend, indemnify, and hold harmless Simon Express from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your misuse of the Services.

We may suspend or terminate your access to the Services at any time, without notice, for conduct that we believe violates these Terms or is otherwise harmful to Simon Express, our personnel, or other users. These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to the personal jurisdiction of those courts.
