3. SMS / Text Messaging

If you have provided your phone number and consent to receive text messages from Simon Express, you may receive SMS or MMS messages from our recruiting team about job opportunities, application status updates, scheduling, and follow-up information.

The following terms apply to all SMS communications from Simon Express:

Consent. You will only receive recruiting text messages from Simon Express if you have explicitly opted in by phone, in person, by web form, or by replying YES to a confirmation message. Consent is not a condition of employment.
Message frequency. Message frequency varies based on your conversation with our recruiting team. You may receive several messages during an active recruiting cycle and few or none otherwise.
Message and data rates may apply. Standard message and data rates from your wireless carrier may apply to all text messages sent or received.
Carriers are not liable for delayed or undelivered messages.
HELP. Text HELP to any Simon Express number to receive help information, or call us at 801-260-7010.
STOP. Text STOP to any Simon Express number at any time to opt out of receiving any further text messages from us. After you send STOP we will send a one-time confirmation message and will not send you any further marketing or recruiting messages until you opt back in.

No mobile information (including phone numbers and SMS opt-in consent) collected by Simon Express will be sold, rented, shared, or otherwise transferred to third parties or affiliates for their marketing or promotional purposes. This restriction applies to opt-in data collected by phone, in person, by web form, or by reply text.

4. How We Share Information

We do not sell your personal information. We share information only as described below:

Service providers. We use third-party providers to operate our business, including telephony and SMS providers (Twilio), email delivery providers (Resend), cloud hosting (Vercel), database services (Supabase), and AI services used to draft outreach messages (OpenAI). These providers process your information only on our instructions and only to the extent needed to provide their service to us.
Background-check and motor-vehicle-record providers. When you formally apply for a driving position, we share information needed to verify your driving history and pre-employment eligibility with the providers we use for those checks. We obtain your written authorization before doing so.
Legal compliance. We may disclose information to comply with applicable law, valid legal process, or government requests, or to protect the rights, property, or safety of Simon Express, our personnel, or others.
Business transfers. If Simon Express is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction. Any successor will be required to honor this Privacy Policy with respect to your information.

We do not share your phone number, SMS opt-in status, or text-message contents with third parties for their own marketing or advertising purposes.

5. How We Retain and Protect Information

We retain your information only as long as needed for the purposes for which it was collected, to comply with our legal obligations, to resolve disputes, and to enforce our agreements. Recruiting communication records and driver-qualification data are retained in accordance with the recordkeeping rules of the U.S. Department of Transportation and Federal Motor Carrier Safety Administration.

We use reasonable administrative, technical, and physical safeguards designed to protect your information against unauthorized access, disclosure, alteration, or destruction. No method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

6. Cookies and Similar Technologies

Our website uses cookies and similar technologies to operate the site, remember preferences, measure traffic, and improve performance. You can control cookies through your browser settings. Disabling cookies may limit some features of the website.

7. Your Rights and Choices

Our services are not directed to individuals under 18, and we do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal information, please contact us so we can delete it.
